Terms of Service

1. The short version
These are the terms under which Startvest LLC provides access to www.adacompliancedocs.comand the associated paid documentation platform (the “Service”). Using the Service means you accept these terms.
Legal boilerplate below. If something is unclear, email tom@startvest.ai and we will clarify in plain English.
2. Who we are
The Service is operated by Startvest LLC, a Service-Disabled Veteran-Owned Small Business registered in North Carolina. Our mailing address is Hampstead, NC. Contact email above.
3. What the Service is
The Service helps small and mid-size businesses produce and maintain documentation relevant to ADA website accessibility compliance. It includes templates, an audit tool that uses axe-core, an accessibility statement generator, document logs, an embeddable feedback widget, and a generated index document you can hand to counsel.
The Service is not legal advice. We are not a law firm. We do not represent you. Nothing produced by the Service is a substitute for consultation with a licensed attorney in your jurisdiction. For specific legal questions about an actual demand letter, lawsuit, or compliance obligation, retain counsel.
4. Your account
You need an account to use the paid platform. You are responsible for keeping your credentials secure and for all activity under your account. Tell us promptly at the email above if you suspect your account has been compromised.
You are responsible for ensuring the people you add as team members are authorized to access the organization’s compliance records.
5. Subscriptions and billing
The Service is offered on a monthly or annual subscription basis through Stripe. Current pricing is published on our pricing page and may change for future subscriptions, never retroactively for an existing period you have already paid.
Annual plans are non-refundable after 30 days. Within the first 30 days of an annual plan you may request a pro-rata refund by emailing the address above. Monthly plans are not refundable once billed but you may cancel at any time; your access continues through the end of the current period.
You can cancel any time through the Stripe customer portal, linked from your dashboard.
6. Acceptable use
You agree not to use the Service to: (a) violate applicable law, (b) infringe intellectual property, (c) upload malware or other harmful content, (d) probe or disrupt our systems, (e) resell the Service without a written agreement, or (f) misrepresent yourself or the organization you are documenting compliance for.
The embeddable feedback widget is intended for accessibility reports on customer websites. Using it to collect unrelated personal data is outside its intended scope and is your responsibility, not ours.
7. Your content
You retain ownership of everything you upload or generate in the Service (your policies, audit results, remediation entries, vendor VPATs, etc.). You grant us the minimum license necessary to store and display it for the purpose of operating the Service for you.
You are responsible for ensuring you have the right to upload any third-party content (for example, a vendor’s VPAT).
8. Our content
Article content, templates, and platform code are copyright Startvest LLC. The compliance documents you generate using the Service are yours; you can use them freely inside your business and share them with counsel, auditors, or regulators.
9. Warranties and disclaimers
The Service is provided “as is.” We do everything reasonable to make it reliable and accurate, but we do not warrant that it is uninterrupted, error-free, or that documents generated from it guarantee a particular legal outcome. A court can always decide differently than the documentation predicts.
To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, Startvest LLC’s total liability for any claim arising from or relating to the Service is limited to the amount you paid us in the 12 months immediately preceding the claim. We are not liable for indirect, consequential, punitive, or lost-profits damages.
11. Indemnification
You agree to indemnify Startvest LLC for any third-party claim arising from your misuse of the Service, your violation of these terms, or your violation of applicable law.
12. Termination
Either of us can terminate your account with notice. If we terminate without cause, we will refund any prepaid amount pro-rata. After termination, you have 30 days to export your data via the Service’s built-in export tools; after that we may delete it.
13. Changes to these terms
We may update these terms. We will post the new version at this URL and update the “Last updated” date above. Material changes that reduce your rights will be announced by email to the address on your account with at least 30 days notice.
14. Governing law and venue
These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws rules. Disputes will be brought in the state or federal courts located in New Hanover County, North Carolina. You consent to that venue.
